JMA Topic: Child Custody cases involving Injunctions

You may currently be in the middle of a divorce and/or custody case when all the sudden you are served with a Temporary injunction for protection by your soon to be ex spouse. This happens far too often then it should, but it happens. Most of the time these injunctions are based on hearsay and not actual evidence. At this point there is no need to get upset or angry, but, you must follow the instructions on this injunction or face criminal charges and/or jail time.

I have had clients in the past (and currently) that come to me asking for help regarding their custody case and they become so worried about the injunction. While many believe this creates a problem, it really does not. It simply changes how we approach this obstical. I will still meet with them and explain the process. This same process that I am going to briefly discuss with you today.

At this point I advise my potential client to retain the services of a reputable attorney and have the attorney contact me when he/she is ready to proceed with our investigation. Once this is completed then all requests, reports, payments, updates, pictures, video, etc go to the attorney and not to the "client," as the "client" is actually the attorney's "client". Therefore, I am working for the attorney and not the "client". This allows the client to still proceed with their initial legal action plans and not worry about going to jail for a violation of injunction. The client then receives updates directly from their attorney. At no point do I release any information to the individual. Not only is this unethical it could also become a legal issue and cause for a violation of the injunction.

You should speak to your attorney about having the injunction dropped as part of your settlement, if you are able to settle out of court. Note, settling out of court is the best option if both parties can come to an agreement. This should be your secondary concern, your children being the primary concern.

GPS Loggers VS GPS Trackers

I absolutely love the GPS Tracking technology! Its simple, it works, provides results and saves my clients hundreds of dollars over traditional methods of following the subject/vehicle. While we do still enjoy working surveillance and tailing vehicles, we also like to offer many options to our clients. With times like this, everyone needs to save money and with JMA we can help you save money while providing you with our professional Investigative services.

My previous blog post, see "GPS TRACKERS," we discussed the numerous options that these wonderful devices offer. Today I want to cover "GPS LOGGERS."


What is a GPS Logger? Well a GPS Logger is very similar to a GPS Tracker with really 1 exception, you do not get the LIVE up to date location info as you would with a GPS Tracker. You still have to decide on a unit that has a battery life that you need and I do not know of any logger that can be hard wired into the vehicle.

A GPS Logger can save the client even more money over LIVE GPS TRACKERS if they do not need that "On demand live update" that some clients do need or prefer. A GPS Logger is placed in the vehicle or subjects belongings and must be retrieved at a later time. The GPS Logger can then be connected to a computer via USB port and the GPS information can be downloaded and viewed on services such as Google Maps.

These devices work fairly well but again, must be retrieved in order to obtain the previous log information. If they are lost, you have no way to find them.

What is all the hype about with GPS Trackers?

GPS Trackers



Awww one of my favorite topics! These devices have come a long way and they are becoming more and more advanced and at fast pace! These devices are getting smaller and smaller. Currently some are about the size of a small matchbox.



GPS Trackers range in price, power supply, battery power, etc. Some GPS Trackers can last for several months while others may only be good for a few days. If a GPS Tracker is hard wired into the vehicle's electrical system then there is no need for the battery.



The joy of a GPS Tracker is that it is always live! You can log on to the tracking website from your computer, some services allow the use of a smart phone, and literally sit and watch the vehicle, subject or whatever item you are tracking live, moving on the map! Depending on what service you use, you can receive speed, elevation, coordinates, etc. You can even set boundaries for when the tracker leaves an area you can receive an email and/or text message. Some trackers even allow you to send a text to the tracker and receive a text reply with the location, speed, etc.



I recently worked a case from another city, hours away from Jacksonville. The subject was driving a vehicle with a GPS tracker covertly attached to the vehicle. With one Investigator hundreds of miles away watching the website, I was receiving updates as one of my Investigator's was being dispatched to catch up to the vehicle. This GPS Tracker really did wonders with locating the vehicle/subject. Had we not had this tracker we may have never found where the subject visited or caught up to the subject.

There are several reason's to make use of a GPS Tracker:
Cheating Spouse, Child Custody, Employee Monitoring or Teenage Driver just to name a few. The use of a GPS Tracker can save the client hundreds and sometimes thousands of dollars! For example, the cost of rental from JMA for a day or by the week is far less then paying our normal $65 an hour fee plus $.50 mileage to have an Investigator following a subject/vehicle 24 hours a day (That's almost $1600 a day plus mileage) that you can monitor at home! Our rental fees are VERY reasonable and require a deposit for the unit which is fully refundable when the tracker is returned to JMA.

Nanny Cams..What they are. What they can do and how they (nanny cams) and JMA can help!

Recently in Jacksonville, FL Nanny Cams have become a big topic. A local woman, that has been babysitting for over 30 years, was recently arrested. The arrest came after the video from a father's nanny cam was used. The full story can be found here

So what is a Nanny Cam? A Nanny Cam is really a covert / hidden camera that has been used for covert / hidden surveillance. In the last several years these cameras have been used to monitor babysitters / nanny's and therefore the term "Nanny Cam" evolved.


These covert camera's range in size, features and cost. Some covert camera's are so small that you do not have to hide them inside any item, while others are bigger but still hidden within a particular item when you purchase them. These camera's can be wired or wireless, run off batteries or electricity and some even have a built in DVR to record video to. These covert camera's do range in cost but many are affordable for any budget!

JMA offers DNA Paternity Testing




Today I want to cover the topic of DNA Paternity Testing. While I was browsing the internet about this topic. I have read over many blogs, forums, etc.

I have noticed that some women absolutely do not like the fact of having a DNA test done at birth. While I was reading over all this information I also found that almost all Men that are "not sure" prefer to have a DNA test done at birth. So why does this cause such a conflict with the mother and potential father?

Example 1, Mother and Father are not married and Father is "not sure" and would like to have a DNA test done before signing the birth certificate. What is wrong with requesting a DNA test? Not a thing!

Example 2, Mother and Father are married and the Father is 90% sure he is the father. Should he request a DNA test? If he is in doubt then absolutely!

Example 3, Mother gives birth but is unsure of the Father. By locating and tracking down the potential Father we can ask that they take a DNA test to confirm that they are or are not the Father. While we, JMA, can not force anyone to take the DNA test, a judge can order the potential Father to take a DNA test.



What we have to keep in mind, regardless if we are the mother or the father, is that we need to make sure the best interest of the child comes first and then the best interest of the Mother AND Father (equally).

While we can not provide any legal advise, I do base my suggestions or comments from my experience in the State of Florida. If you are unsure that you are the father, you do NOT have to sign the birth certificate. You CAN request a DNA test and you CAN have your name added to the birth certificate at a later time. Once you sign your name, you are the responsible for the child even if he/she is not yours. It is always better to be safe then sorry!

On February 21st, 2010 we will be sponsoring 2 bowling lanes at the Cassat Batt Bowl, 1838 Cassat Ave, Jacksonville, FL 32210. This Fundraiser is scheduled for 11am to 2pm.

We ask that everyone join us as we raise money for Alex Ross and his family to cover medical expenses. Alex is a 16 year old who was accidentally shot last month and was not expected to live, but is now improving daily.

In order to help the community prevent further tragedy like this from occurring, JMA and One Shot Firearms Training, Inc. will also provide a FREE Firearms Awareness and Safety Training Class to individuals that donate $100.00 or more to the Alex Ross Fundraiser. This will be limited to the first 30 individuals and a NRA Certified Instructor will conduct the class.

I am honored to have received the John M. Russi Award, as well as the Florida Association of Security Officers' endorsement for my Commissioner of Agriculture race. The support of security officers means a great deal to me, both personally and professionally.

Those who protect the rights and safety of others deserve the very best. I have worked to ensure that our security officers have the best equipment, the best training, and the best environment to protect Floridians.

As a state legislator, I have sponsored and supported bills which enhanced the personal safety and protection of Licensed Security Officers. I sponsored the bill which allowed security officers to upgrade their weapons, so they would be better equipped to handle any potential threats. I also sponsored legislation which increased the penalties for assaulting a security officer, raising punishment to the same level as assaulting a police officer.

As some of my closest and most dedicated supporters, you deserve to hear this message from me first. I want to thank you from the bottom of my heart for the help you have given me in my campaign for the Commissioner of Agriculture seat. You've answered the calls, reached out to friends and helped make a difference in this race.

As with any campaign, you have to achieve certain objectives to set yourself up for victory. I had to prepare myself to wage a full-scale campaign that would give Floridians a chance to see what I had to offer them if elected Commissioner of Agriculture. This would not be an easy task in a big state like ours, but nothing ever worth pursuing is easy.

Unfortunately, I was unable to meet those goals. And so I was faced with a difficult decision, but ultimately a necessary one. With so many other challenges to address in our state, particularly in the Legislature, it would be wrong of me to continue a campaign when I have not met the goals I need to win. It's time for me to choose where I am most prepared to help the people of Florida.

Today, I will be announcing my withdrawal from the Commissioner of Agriculture race. While I withdraw my candidacy with a heavy heart, I know that as a full-time Senator, I can continue to make a difference and make you proud.

  • 2007: We successfully lobbied for a change in FS316 to allow security vehicles to display amber and green lights.
  • 2008: We established joint conferencing with the Florida Association of Licensed Investigators.
  • 2009: We became a Founding Member in the Council of Presidents representing all Chapter 493 licensees, and FASCO successfully prevented the raiding from the Division of Licensing Trust Fund by the legislature.
In the coming years, among other legislative efforts, we hope to see changes in FS493 that will expressly allow security officers the authority to detain subjects who commit crimes on or threaten the properties we protect. We also hope to offer direct support to our members in the form of better access to professional development opportunities, business management tools, and networking with other owners and managers.
